Project description

The study will focus on the main issues that significantly impact the initiation and handling of representative claims in the EU, which are not harmonised under Directive 2020/1828. Specifically, the emphasis will be on the following three issues:

  • Burden of proof, access to evidence, and disclosure of information,
  • Financing of collective redress actions, with a focus on third-party funding and court fees, and
  • Quantification of (immaterial) damage, especially in cases where infringements occur in digital environments.

In addition to Prof. Dr. Wannes Vandenbussche, the consortium includes Prof. Dr. Peter Rott (University of Oldenburg, Germany), Prof. Dr. Alex Halfmeier (Leuphana University Lüneburg, Germany), Dr. Laura Bugatti (University of Brescia, Italy), and Jagna Mucha (University of Warsaw, Poland).
