This project aims to reconstruct a legal scientific positive doctrine for Belgian liability law. The prevailing doctrine is tested against the decisions in case law (falsification of theory), and, where possible, alternative legal rules are sought that may more accurately reflect this legal reality. Ultimately, this project will culminate in a rewriting of the doctrine that truly represents the liability law as it exists in Belgium.
