Project description

Whether non-injured States and international organizations can take non-forcible countermeasures remains one of the most vexing issues of international law. In 2001, the International Law Commission left the question open, as it found State practice to be ‘embryonic’. The objective of this project is to examine the wide range of countermeasures taken since 2001 in order to shed greater clarity on customary international law in this domain.
