This project researches how the “best” balance can be found between the protection of a deceased’s surviving spouse/partner and his/her children. This topic is controversial (especially in the context of reconstituted families). More specifically, the most just balance is sought after taking into account empirical-sociological findings and solutions put forward by legislators in comparable societies.
