Project description

The digitalization of the Judiciary in the EU affects its organization, workflows, procedures and output. This research investigates the relationship between the autonomy of IT-governance and the independence of the Judiciary. A theoretical section describes consecutively: 1) the concepts of IT, IT-governance, Judiciary, Independence and Autonomy; 2) the relationship between IT governance and judicial independence; 3) the autonomy of IT governance within the EU; 4) its impact on Independence; 5) the conditions to be met. A comparative law section examines how this is applied in EU countries with autonomous IT governance. The research is based on a literature review and offline and online desktop research of international, European and national regulations, case law, and legal doctrine, complemented by a survey of IT-governance bodies in the examined EU countries.
